Although the group was active in the Sotomayor and Kagan confirmations during the Obama administration, as well as in the fights over the use of the filibuster, there was a limit to how much could be done with a hostile administration. The group took the opportunity to expand its work into state judicial selection as well as commentary on major Supreme Court cases from a perspective of the same textualist and originalist philosophy it promoted in judicial nominees.
